From what I have read, the birth narrative, the tomb narrative and the trial narrative can all be dismissed as pure fictions, though they were designed to allude to Jewish prophecy first. As a someone who had no Roman citizenship, nor any importance to the Judean ruling class, he had no right to any trial, or rights at all. Tossing tables in the Temple during the volatile Passover period would have been seen as an act of rebellion and immediate grounds for arrest and crucifixion. The above narratives were to cover up for wealthy, powerful listeners what the other narratives made plain: that he was a commoner and crucified like a base criminal.
